Zero-Tolerance Policy

At Black Rider, the safety and comfort of our passengers are our top priority. We enforce a strict zero-tolerance policy regarding the use of alcohol, illegal drugs, or any intoxicating substances by our drivers at all times.

All chauffeurs undergo regular screenings, background checks, and ongoing training to ensure compliance with this policy. If a passenger ever suspects that a driver may be under the influence of drugs or alcohol, they are encouraged to refuse the ride immediately and report the incident to our management team.

Additionally, passengers may also file a complaint directly with the City of Dallas by dialing

3-1-1,

in accordance with Ordinance 29696.

This policy is in place to ensure that every ride you take with us is safe, professional, and reliable.

This document constitutes the official Zero-Tolerance Drug & Alcohol Policy of Black Rider LLC and is provided to comply with applicable state and local regulations.

ZeroTolerance Intoxicating Substance Policy

Black Rider LLC

Effective Date: 12/01/2025

1. Purpose and scope

Black Rider LLC is committed to maintaining a safe and productive, drug and

alcoholfree workplace to protect employees, customers, and the public. This policy

applies to all employees, applicants, temporary workers, contractors, and

subcontractors while they are on company premises, operating company vehicles or

equipment, or performing work for or on behalf of Black Rider LLC at any location.​

2. Definitions

For purposes of this policy:

 “Intoxicating substances” include alcohol, illegal drugs, controlled substances

without a valid prescription, misuse of prescription medications, synthetic drugs,

and any other substance that may impair judgment, coordination, or safe job

performance.

 “Under the influence” means any detectable level of an intoxicating substance in

the body, or observable impairment in speech, behavior, coordination, or

judgment, as determined by management, law enforcement, or a certified testing

facility.​

3. Zerotolerance rule

The following conduct is strictly prohibited and constitutes a violation of this

zerotolerance policy:

 Use, possession, sale, distribution, manufacture, or purchase of intoxicating

substances on company premises, in company vehicles, or while performing

company business.

 Reporting to work, or remaining at work, under the influence of intoxicating

substances.

 Misuse of prescription or overthecounter medications in a way that impairs safe

performance of job duties.

Any violation of this section will result in immediate removal from duty and may result in

termination of employment on a first offense, subject only to any mandatory

rehabilitation or lastchance requirements applicable under specific contracts or laws.​

4. Drug and alcohol testing

To enforce this zerotolerance policy, Black Rider LLC may require testing in the

following situations, consistent with Texas guidelines for private employers:

 Preemployment or preassignment testing.

 Postaccident or postincident testing when there is an injury, property damage, or

safetyrelated event.

 “Reasonable suspicion” testing when there is credible observation of possible

impairment (odor, behavior, speech, unsafe acts, possession, etc.).

 Random testing for employees in safetysensitive positions (such as drivers or

equipment operators), or as required by contract or regulation (including

DOTregulated positions, if applicable).​

Refusal to submit to a required test, tampering with a sample, or failure to cooperate

with the testing process will be treated as a policy violation and may result in

termination.​

5. Prescription and overthecounter medications

Employees who are taking medications that may impair alertness or safe performance

must inform their supervisor or HR before duty, without disclosing the diagnosis, so that

an evaluation can be made regarding fitness duty and any temporary modification of

work assignments. The lawful use of prescribed medications is not prohibited, but

employees must not perform safetysensitive duties if impaired.​

6. Consequences and discipline

Because Black Rider LLC follows a zerotolerance approach to intoxicating substances

in the workplace:

 A confirmed positive test result verified rule violation, or refusal to test may result

in immediate suspension pending investigation and usually termination on the

first offense.

 In limited cases, at the sole discretion of the company and where consistent with

applicable contract requirements, an employee may be offered a lastchance

agreement requiring evaluation, treatment, and returntoduty testing rather than

termination.​

Nothing in this policy limits the company’s right to notify law enforcement where

appropriate or to seek civil remedies for damages arising from a violation.

7. Employee education and acknowledgments

Black Rider LLC will:

 Provide employees with a copy of this policy and any updates, and obtain

written acknowledgment of receipt.

 Periodically remind employees of the dangers of workplace substance abuse

and review policy requirements and consequences, consistent with drugfree

workplace best practices.​

Employees who have questions about this policy or who believe they may have a

substanceuse problem are encouraged to seek assistance before a violation occurs.

Requesting assistance does not excuse a current violation of this policy or prevent

discipline for such violation.

8. No contract of employment

This policy does not alter the atwill nature of employment (if applicable) and does not

create a contract of employment or guarantee of continued employment for any period.

Black Rider LLC reserves the right to modify or revoke this policy at any time, subject

to applicable law and contractual obligations.
